Terms and Conditions for Merchandise Sales

These Terms and Conditions (“Terms”) govern the purchase of merchandise from Permanently Disabled Jockeys Fund (“we,” “us,” or “our”). By placing an order, you agree to these Terms.

1. Purpose of Sales

All merchandise sales support the charitable mission and programs of Permanently Disabled Jockeys Fund, a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code and organized under the laws of Kentucky.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase, or have permission from a parent or legal guardian.

3. Orders and Acceptance

• All orders are subject to acceptance and availability.
• We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information.

4. Pricing and Payment

• Prices are listed in United States Dollars ($) and are subject to change without notice.
• Payment must be made in full at the time of purchase using approved payment methods.
• Applicable taxes and shipping fees will be added at checkout where required by law.

5. Donations vs. Purchases

• Merchandise purchases are generally not tax-deductible because goods are received in exchange for payment.
• If a portion of a purchase qualifies as a tax-deductible charitable contribution (for example, where the payment exceeds the fair market value of the merchandise), the deductible amount will be clearly disclosed at checkout and acknowledged in writing, in accordance with IRS regulations.

6. Shipping and Delivery

• We ship to 48 contiguous United States usually via the United States Postal Service.
• We ship within a week of ordering, usually within two (2) days.
• Delivery times are estimated to be within a week of shipping and not guaranteed.
• We are not responsible for delays caused by carriers, customs, or events beyond our reasonable control.

7. Returns, Exchanges, and Refunds

Returns or exchanges are accepted within 30 days of delivery for unused items in original condition.

• For returns or exchanges please contact info@pdjf.org for return authorization.
  • No returns or refunds on used merchandise.
• Refunds, if approved, will be issued to the original payment method.
• Shipping costs are non-refundable unless required by law.

8. Defective or Incorrect Items

If you receive a defective or incorrect item, please contact us at info@pdfj.org within 15 days of receipt. We will arrange a replacement or refund where appropriate.

9. Intellectual Property

All logos, designs, text, and artwork on the merchandise are the intellectual property of Permanently Disabled Jockeys Fund or its licensors and may not be used without prior written permission.

10. Limitation of Liability

To the fullest extent permitted by applicable nonprofit and consumer protection laws, To the maximum extent permitted by law, Permanently Disabled Jockeys Fund shall not be liable for any indirect, incidental, or consequential damages arising from the purchase or use of merchandise.

11. Disclaimer of Warranties

Merchandise is provided “as is” without warranties of any kind, express or implied, except where prohibited by law.

12. Privacy

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Kentucky, United States, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of purchase will apply.
